While this guide concentrates solely on family-based immigration, there are other options
available to live and work in the US legally, such as employment based categories.
Although fewer immigrant visas are given to the employment based categories (140,000
annual visas versus 480,000 in the family based categories), fewer applications are
submitted in the employment categories, which results in much faster processing times.
In dealing with employment based immigration it is suggested to consult or obtain the
services of a lawyer.
Here are the five employment visa categories:
Category 1: Priority workers Eligible to apply for this category are:
Foreign nationals of extraordinary ability in the sciences, arts, education, business or
athletics.
Foreign nationals that are outstanding professors or researchers.
Foreign nationals that are managers and executives wishing to transfer to the United
States.
Category 2: Professionals with advanced degrees orpersons with exceptional ability
Eligible to apply for this category are:
• Foreign nationals of exceptional ability in the sciences, arts or business.
• Foreign nationals that are advanced degree professionals.
• Qualified physicians who will practice medicine in an area of the United
States which is lacking a sufficient amount of medical personnel.
Category 3: Skilled or professional workers
Eligible to apply for this category are:
• Foreign national professionals with bachelor's degrees (who don't qualify
for a higher preference category).
• Foreign national skilled workers (minimum two years of training and
experience).
• Foreign national unskilled workers.
Category 4: Special immigrantsEligible to apply for this category are:
• Foreign national religious workers.
• Employees and former employees of the United States government
abroad.
• Spouse or Child of an Abusive U.S. Citizen (self petitioning).
Category 5: Immigrant investors
Eligible to apply for this category are individuals who meet all of the following
conditions:
a. Foreign nationals who have invested or are in the process of investing a
required amount of money into a new business (whether an original
business or purchase and expansion or reconstruction by certain
standards of existing business).
b. The amount of money invested currently needs to be at least $1,000,000,
or $500,000 in specially designated areas.
c. Create full time employment for no fewer than 10 qualified individuals
or maintain the number of existing employees for at least two years (in
certain businesses that are currently losing money).
